The Montana Standard, Butte, Friday, November 9, 1979 5 Former postmistress, Shining Mountains' owners Margaret Quigley, dies 10 million suit mm smmrmFrfl I Highway hearing noted object of VIRGINIA CITY A 10.85 million class action suit alleging fraud and breach of contract was filed Thursday in Virginia City district court against the owners and agents of the Shining Mountains Subdivision. The huge development is located about five miles southwest of Ennis in Madison County. The complaint lists names of more than 103 plaintiffs, identified as owners of property within the three units of the subdivision: Defendants are Don and Pann Mallas, doing business as Mallas Associates, and general partners of the Shining Mountains, a California limited partnership. Also, includes a frontage road north of the railroad. Alternate 3 is the two-lane road along the south valley.

Alternate 4 is to leave the road in its present situation. Copies of the draft environmental statement report, maps and other information will be available at Highway Department offices in Butte and Helena. Written and verbal comments can be presented at the hearing. Written statements can be sent up to 10 days after the hearing to the Helena highway office. Louie Stokan, 52 Anaconda native Louis Stokan, 52, an out-patient at the veterans' medical center at Minot, N.D., died Tuesday In his home in Underwood, N.D. He had undergone surgery several times recently. Born to Mrs. Mildred Stokan and the late Joseph Stokan May 31, 1927, he attended local schools. He enlisted in the Navy during World War II and served In the Pacific.

He retured to Anaconda in 1946 and worked with the Anaconda Co. He worked the last seven years with McKce Construction and was a foreman prior to his illness. He was a member of St. Paul Church, American Legion, Elks and a 30-year member of the Pipefitters Union. He married the former Jacqueline Jones in Anaconda in February 1977.

Surviving besides his wife and mother are a sister, Mrs. Dom Macchia, Morristown, N.J.; and mother-in-law, Juanita Jones of Anaconda, Services are pending at the Parson Funeral Chapel. Legon plans party Sunday Veterans Day will be observed by Anaconda American Legion with an open house and a dinner Sunday in the hall. Veterans and their ladies are invited. The open house will be 2-5 with a no-host bar.

Bill Stuart will provide organ music. The dinner starts with a no-host social at 6:30. There will be a nominal charge for the meal prepared by the Auxiliary. A 25-block chase through the Mining City at up to 60 mph in dense fog early Thursday left two persons charged with careless driving.

Police said they took chase after observing two cars make illegal left turns off Montana onto Gold. The report said one driver disobeyed seven stop signs before he was stopped at Aluminum and Dakota. That driver said he had been fighting with the occupants of the other vehicle and was trying to evade them. Both drivers were ticketed and ordered to appear in police court. Services will be Saturday at 2 in Brundage Funeral Home. Burial will in Mountain View Cemetery. Mr. Faller was born in Thornville, Ohio, Nov. 29, 1888.

He moved to Dillbn in 1912. He' and Ann Shields married Feb. 7, 1921, In Dillon. She survives. He was Dillon postmaster 1924-33, director of the Selective Service and the local employment office, and an agent for State Farm Insurance.

Mr. Faller was a World War I Army veteran, serving in France. He was one of the founders of Beaverhead Post 20 of the American Legion. He also was founder of the Beaverhead Barracks of the Veterans of World War and was a past state commander. He was an active member of the Masonic lodge.

The contract agreements were breached, the plaintiffs claim, when the defendants in a conspiracy offered those buying lots in the other subdivisions the right to use the common areas and easements. The plaintiffs also claim the defendants formed the Shining Mountains Owners' Association, a non-profit corporation, on May 24, 1973, to manage the protective covenants of the three subdivision units. They say a controversy has arisen over the association because the defendants amended the articles of incorporation on Jan. 25, 1978, to.

include the other subdivisions. The court is asked to rule on the plat provisions relative to the common areas and easements and declare that the exclusive use rights belong to the plaintiffs. A judgment declaring the amendment of the articles of incorporation to include other subdivisions as an illegal act also is sought. The plaintiffs ask $500,000 for building the roads, $50,000 for the dam construction, $250,000 in general damages and $10 million "for the sake of example and by way of punishment of the defendants." He was born July 17, 1893, to Mr. and Mrs. Alonzo Hendricksen. He served with the Army's 1st Division Signal Battalion in World War I. He lived in Butte 34 years and was self-employed at the Central Garage.

Mr. Morrill enjoyed hunting and fishing and was' captain of the American Legion rifle team 1934-41. He was a member of the Elks and the Masonic lodge. Survivors include his wife, Delia; son and daughter-in-law, Mr. and Mrs.

Arlen Morrill Jr. of Browns Gulch; stepdaughters, Betty McGill and Dori Braden, both of California; sister, Clara Carlson of Washington; grand-' children, Thomas Morrill and Deana McManus of Butte; and three great-grandchildren.
